Terms and conditions of sale
Article 1 - Purpose
The present general conditions of sale are applicable to all sales made on the website www.basket4ballers.com and concluded between the company Basket4ballers on the one hand, hereinafter referred to as "Basket4ballers", and any natural person wishing to make a purchase via the "Basket4ballers" website on the other hand, hereinafter referred to as "the buyer". Placing an order implies the buyer's full acceptance of the present terms and conditions. Basket4ballers reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in effect at the date of the buyer's order.

Article 3 - Characteristics of the goods offered
The products offered are those shown on the www.basket4ballers.com website. These products are offered while stocks last.
Due to the very high demand for certain items, it cannot be ruled out that, in very exceptional cases, more pairs may be sold than we have in stock. We would like to inform the customer of this potential problem, which may occur if our system is overloaded. Orders for shoes released on a Saturday will be checked the following Monday. Please note that an order confirmation only confirms receipt of your order. On the other hand, it is only when you receive an e-mail containing a tracking number from the carrier that your purchase is 100% confirmed and the goods have been dispatched.
The photographs presented on the site are as accurate as possible, but cannot ensure perfect similarity with the products offered, particularly with regard to colors.
Article 4 - Rates
The prices shown on the www.basket4ballers.com website are inclusive of VAT in euros, applicable on the date of the order. Any change in the rate may be reflected in the price of products or services. Basket4ballers reserves the right to modify its prices at any time, it being understood however that the price appearing on the site on the day of the order will be the only one applicable to the purchaser. Prices do not include shipping costs (see Shipping).
Promotional codes are valid only once per customer, and cannot be reused for an exchange.
Article 5 - Ordering
Buyers wishing to purchase a product must :
create a customer account by filling in the identification form with all the required details, or log in if you already have a customer account on the www.basket4ballers.com website,
validate the contents of the order after checking it,
make payment in accordance with the conditions laid down,
confirm order and payment. Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke one's own terms and conditions of purchase or any other terms and conditions. All data supplied and the recorded confirmation shall be deemed proof of the transaction. Confirmation shall constitute signature and acceptance of the operations carried out. The seller will send confirmation of the registered order by e-mail.
Article 6: Shipping costs
Please refer to the Frequently Asked Questions section of the Website for costs, delivery times and available delivery methods.
If your purchase exceeds the threshold applicable to your country of delivery, you will benefit from free "standard delivery". Please refer to the Frequently Asked Questions section of the Website for the applicable thresholds and corresponding reduced delivery rates.
Article 7 - Payment terms
The price is payable at the time of order. Payment will be made at the purchaser's discretion:
By credit card (3D secure system)
By Paypal
- Payment by instalments with Alma
Payment by instalments/deferred payment is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
Purchase amounts
- P2X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
- P3X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
- P4X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
Fees
When paying in instalments with Alma, the Customer does not pay any charges. Except in the following cases:
- P2X: 0.65% per transaction
- P3X: 1.31% per transaction
- P4X: 1.95% per transaction
Alma is a telepayment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.
Cancellation
Any termination of the General Terms and Conditions binding the Vendor and the customer shall result in the termination of the General Terms and Conditions between Alma and the customer.
Article 8 - Deliveries
Deliveries are made to the address indicated by the purchaser on the order form. The purchaser must provide all the information concerning his/her address that will enable the order to be delivered. The customer will be asked to pay 10€ for re-shipment of sapai order in the event that the order is returned due to a lack of address information, or in the event that the parcel is not collected from the post office.
Packages generally remain at the customer's disposal for 7 days (72 hours in Pickup points). After this time, your parcel will be returned to us.
In the event that a parcel is lost due to return to sender or address error, the customer is considered responsible for the loss of the parcel and no compensation can be claimed from Basket4Ballers.
Once the order has been set to "preparation in progress", it is too late to change the delivery address.
The customer is solely responsible for checking his parcel upon receipt with the deliveryman and/or the relay point, and reservations must be made immediately with the deliveryman and/or the relay point in the event of a problem (damaged parcel, empty parcel, missing item, etc.).
In the case of deliveries of goods outside the EU, customs duties may apply at the time of delivery, for which basket4ballers cannot be held responsible.
In the case of deliveries to French overseas departments and territories, as well as outside the European Union, customs duties and/or octroi de mer fees may apply at the time of delivery, for which basket4ballers cannot be held responsible.
Article 9 - Withdrawal
Purchasers, non-professional individuals, benefit from a fourteen-day cooling-off period from receipt of their order to return the product to the seller for reimbursement without penalty, with the exception of return costs, which are payable by the customer. See "our return conditions":

No delivery dispute will be accepted after this period. The customer is responsible for checking the condition of the items delivered.
Any anomaly concerning the items (damage, missing item compared to the order form, damaged or opened package, broken or defective item, etc.) must be indicated within 3 days of delivery by e-mail to contact@basket4ballers.com.
Article 10 - Exchanges, Returns, Warranty & Customer Service
All products supplied by the seller are covered by the legal warranty stipulated in articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it or reimburse it.The usual effects of wear and tear, however, are not covered by the legal warranty.All claims must be made by e-mail to the following address: contact@basket4ballers.com. Socks are considered underwear and cannot be exchanged or refunded after fitting.
Basketball shoes wear out very quickly (an average of 3 months for a pro player), and this wear depends on the use made by the customer and the frequency of use. Basket4Ballers will only exchange products which, due to an obvious manufacturing defect, can no longer be used for basketball. Basketball shoes on sale at Basket4Ballers are intended for indoor basketball use only. All pairs of basketball shoes used outdoors cannot be claimed as defective.
All requests for returns due to defects must first be validated by customer service by sending photos of the defect(s) to contact@basket4ballers.com.
Condition of returned items
All items returned within the legal withdrawal period must be returned perfectly intact and in their original packaging (shoe box, original packaging, accessories, instructions, plastic...).
Upon receipt of the package, Basket4Ballers will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned items have been visibly used or damaged by the customer and such use or damage renders the items unfit for sale. If the return is refused by Basket4Ballers, the items will then be returned to the customer at the customer's expense without the customer being able to demand any compensation or right to reimbursement and Basket4Ballers will be able to exercise all corresponding recovery actions against the customer.
Exchanges
It is currently impossible to exchange items, but you can return them to us. See items above. For information on refunds, please refer to the following article. To obtain another color or size, you will need to place a new order on the Website.
Refunds on returns
Subject to compliance with these return conditions, Basket4Ballers will refund returned items within 14 days of receipt of the return or proof of shipment of the return via a tracking number, for example.
Refunds will be made according to the method of payment initially chosen. No cash refund will be made by Basket4Ballers in the event of the return of one or more items paid for by gift card. Only the additional amount paid when using the gift code will be refunded if the returned item complies with the return conditions.
Article 11 - Liability
In the online sales process, the seller is bound only by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.
Article 12 - Personal data
In accordance with the French Data Protection Act of January 6, 1978, personal data relating to purchasers may be processed automatically. Users have the right to access and rectify data concerning them, in accordance with the law of 6 January 1978.
Article 13 - Archiving and proof
Basket4ballers will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code. Basket4ballers' computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Article 14 - Settlement of disputes
These conditions of online sale are governed by French law. In the event of litigation, jurisdiction is attributed to the competent courts of Strasbourg unless otherwise provided by law.
Article 15 - Gift cards
The customer may purchase one or more gift cards on the Basket4ballers.com and B4bsneakers.com websites. These gift cards can only be used on the Basket4ballers.com and B4bsneakers.com websites.
Gift cards can only be paid for by credit card or bank transfer.
When creating a gift card, the customer must enter the gift card recipient's e-mail address. This e-mail address cannot be subsequently modified.
No cancellation request will be accepted if the gift card has been activated by its beneficiary. A gift card is considered to have been activated when its value has been credited to the beneficiary's customer account in the form of a gift voucher.
Basket4Ballers and B4Bsneakers cannot be held responsible for any error in the e-mail address of the recipient of a gift card.
The gift card is valid for one year from the date it is sent to the recipient. It cannot be exchanged for cash.
If the gift card is not activated within one year of its issue date, the corresponding amount will be considered to have been definitively acquired by Basket4Ballers.
Basket4Ballers and B4Bsneakers reserve the right to cancel any order for a gift card, gift voucher or order for items paid for using one or more gift vouchers which, in their opinion, presents a risk of fraud.
Gift card activation/voucher conversion
The gift card recipient will receive an e-mail containing a discount code. He/she will have to click on this unique link in order to identify himself/herself on the Basket4Ballers and B4Bsneakers website if he/she already has a Basket4Ballers and B4Bsneakers account or create his/her Basket4Ballers or B4Bsneakers account in order to activate his/her gift card.
When a gift card is activated, the corresponding amount is made available to the recipient in the form of a gift voucher.
This gift voucher will be available in the form of a discount code in the beneficiary's customer account, which they can enter in the corresponding box when validating their basket.
The gift voucher is valid for one year from the date of issue. It is neither breakable nor refundable, and cannot be exchanged for cash.
In the event of the return of an item paid for with a gift voucher, Basket4Ballers or B4Bsneakers will reimburse only the possible monetary supplement and will reactivate in the form of a gift voucher the amount paid with the initial gift voucher.
